President Obama to Sign Executive Order Protecting Gay Rights

By Katherine Tracy

Do you work for or own a company that does business with the federal government? If so, a new Executive Order President Obama intends to sign may impact you. Currently, federal and state laws prohibit employers of a certain size from discriminating against employees based on their gender, race, nationality, disability, age and other protected classes. But, federal laws and twenty-nine states do not protect employees from discrimination based on sexual orientation or gender identity.

It appears that things are set for change if President Obama signs the new Executive Order – at least with certain companies. The Order would prohibit companies that do business with the federal government from discriminating against employees based on sexual orientation and gender identity. Is your company one of these companies?

The Order itself could affect as many as 16 million employees. Are you one of these employees?

The Order may be related to the House of Representative’s failure to pass the administration’s Employment Non-Discrimination Act,  which would prohibit employers from discriminating against an employee based on their sexual orientation or gender identity. While the bill passed the Senate it has stalled in the House.

Regardless of whether the Executive Order causes movement in the House on the ENDA, the Order will place additional restrictions on companies doing business with the federal government.
